Royal Decree Published for Thai VAT Exemption for Data Center Businesses — Orbitax Tax News & Alerts

On 9 November 2022, the Thai Revenue Department published Royal Decree 759 regarding the VAT exemption to promote investments in data center businesses and establish Thailand as a digital hub in the region. As previously reported, the VAT exemption was first announced in June 2022 for data hosting services, including:

  • the provision of servers and related equipment for the purpose of storing, processing, and connecting information through the internet; and
  • the provision of related support services for the above, including data backup services, network connection services, cloud services, and system management and information security services.

The exemption is available for qualified data center business operators that comply with all rules, procedures, and conditions as prescribed by the Revenue Department and have notified their intention to request the exemption (i.e., apply) within 5 years from the date the Royal Decree comes into force, which is 5 years from 9 November 2022.
