ARTICLE 29

Termination

(1) This Agreement shall remain in force for indefinite period until terminated by one of the Contracting States.

(2) Either Contracting State may terminate the Agreement, through diplomatic channels by giving notice of termination, at least six months before the end of any calendar year following after the period of at least five years from the date on which this Agreement enters into force. In such event, the Agreement shall cease to have effect:

  • (a) in the Slovak Republic:
    • (i) in respect of taxes withheld at source, to amounts of income derived on or after 1 January in the calendar year next following the year in which the notice of termination is given,
    • (ii) in respect of other taxes on income, for taxes chargeable for any tax year beginning on or after 1 January in the calendar year next following the year in which the notice of termination is given,
  • (b) in Malaysia:
    • (i) in respect of Malaysian tax, other than petroleum income tax, to tax chargeable for any year of assessment beginning on or after 1 January in the calendar year following the year in which the notice is given;
    • (ii) in respect of petroleum income tax, to tax chargeable for any year of assessment beginning on or after 1 January of the second calendar year following the year in which the notice is given.

IN WITNESS WHEREOF, the undersigned, duly authorised thereto, by their respective Governments, have signed this Agreement.

DONE in duplicate at Kuala Lumpur, this twenty-fifth day of May 2015, each in the Slovak, Malay and English languages, the three texts being equally authentic. In case of any divergence in the interpretation and the application of this Agreement, the English text shall prevail.
