4.1. Domestic PE of a Foreign Entity

The law does not define the concept of permanent establishment, but that of an enterprise carried out in Guinea. A non-resident is deemed to carry out an enterprise in Guinea if it habitually conducts business therein through either (a) an establishment, meaning a fixed autonomous installation, (b) a dependent agent, or (c) a complete lucrative cycle (e.g. purchase and resale of goods).
