2.1.4. Trust

There are limited regulatory requirements governing the creation of trusts as a business form, except for unit trusts whose units are marketed for public subscription, and trusts established in the form of superannuation funds. In the case of the former, the Corporations Act prescribes conditions to be met prior to the invitation being made to the public, including the requirement that the issuing entity concerned enters into a trust deed and appoint a trustee in the manner prescribed in the law.
