Russia Relaxing Conditions for Ultra-Low Tax Regime for IT Companies — Orbitax Tax News & Alerts

The Russian Government has issued a release on the agenda of a meeting held on 25 May 2022. Among other things, further support for IT companies was discussed that would involve relaxing the conditions for the "ultra-low tax regime". The regime was introduced in 2020 and includes two main benefits:

  • a reduction in the corporate tax rate to 3%; and
  • a reduction in social security contributions to 7.6%

To qualify, the following conditions must be met:

  • the company must have state accreditation as an organization engaged in information technology activities in accordance with the order established by the Russian Government;
  • the share of revenue of the company from its computer programs, databases, the transfer of exclusive rights, licensing, etc., must amount to at least 90% of its total revenue for the reporting (tax) period; and
  • the average number of employees during a reporting period must be at least 7 people.

As discussed in the meeting, the last two conditions will be relaxed, with the percentage of total revenue reduced to 70% and the employee condition removed. It is also noted that as part of a series of measures to counter the effects of sanctions, an income tax exemption (0% tax rate) for accredited IT companies has already been introduced for three years from 2022 to 2024.
