Luxembourg Partially Restores Public Access to Beneficial Ownership Registry — Orbitax Tax News & Alerts

On 6 December 2022, Luxembourg's Ministry of Justice issued a release announcing that public access to the ultimate beneficial ownership registry (RBE) is partially restored. Public access was recently suspended following the Court of Justice of the European Union (CJEU) judgment finding that public access to ultimate beneficial ownership registry information seriously violates the right to privacy and the protection of personal data (previous coverage).

According to the release, the Ministry of Justice and the State Information Technology Center have found a technical and legal solution to allow partial access in accordance with the conditions set by the CJEU. In particular, access has been restored for certain professionals who already had identified access to the RBE. Further, access will be restored in the coming days to representatives of the press (journalists) who have a legitimate interest in being able to consult the RBE in the context of their journalistic research. Access for national journalists will be managed by the Luxembourg Press Council within the framework of an agreement with the Luxembourg Business Registers. Lastly, access will be restored in a later stage for other persons having a legitimate interest and having a link with the fight against money laundering and the financing of terrorism.
