Gibraltar to Terminate Tax Agreement with Spain if Not Removed from Non-Cooperative List — Orbitax Tax News & Alerts

The government of Gibraltar is reportedly planning to terminate the tax agreement with Spain if it is not removed from Spain's list of non-cooperative jurisdictions. Gibraltar has been listed in Spain's tax haven list and remains listed in Spain's new non-cooperative jurisdiction list, which is currently under consultation (previous coverage). The tax agreement, which was signed by Spain and the UK (on behalf of Gibraltar) on 4 March 2019, includes provisions on tax residence, administrative cooperation in tax matters, and other matters. The tax agreement entered into force on 4 March 2021 and has generally applied since that date. With the agreement, Gibraltar was expected to be removed from Spain's tax haven / non-cooperative jurisdiction list.
