Anti-avoidance measure: hardening of reporting obligation for banks — Orbitax Tax News & Alerts

A bank reform law (Law 2013-672 of 26 July 2013, loi de séparation et de régulation des activités bancaires) was published in Official Journal No. 0173 of 27 July 2013. This law aims to harden the fight against tax havens. Thus, French banks will bear a new reporting obligation. Details of the new reporting obligation are summarized below.

French banks will be required to report annually the list of their foreign subsidiaries. The reporting will include the following specific details on the nature of their business:

-   transactions;
-   sales;
-   profits;
-   employees;
-   taxes paid;
-   and public aid received.

The new reporting obligation applies from 1 January 2013.
